decree nisiA conditional decree of divorce, nullity, or presumption of death. For most purposes the parties to the marriage are still married until the decree is made absolute (although not for all purposes; for example, a husband may be guilty of raping his wife after a decree nisi). During the period between decree nisi and decree absolute the Queen’s Proctor or any member of the public may intervene to prevent the decree being made absolute and the decree may be rescinded if obtained by fraud. If the parties effect a reconciliation, they may have the decree nisi rescinded. |
