tenant in tail after possibility of issue extinctThe interest of an original tenant in *tail special when the specified spouse has died and there are no heirs entitled to succeed to the entailed interest. The tenant in tail retains his powers under the Settled Land Act 1925 (see *settled land) but cannot bar the entail (see *entailed interest). This position cannot arise when the land is held in tail general, since while the tenant in tail lives there is always a possibility he may have children by another wife. |
