tender before action

A *defence to a claim for a debt or liquidated demand alleging that the defendant offered to pay the sum claimed before the plaintiff began his action. In order to rely upon this defence the defendant must pay the sum tendered into court and give notice of the payment to the plaintiff. See also *payment into court.
