unruly characterThe character of a child over the age of 14 when it is such that he cannot be committed to the care of a local authority. If, when making an interim care order in respect of the child, the court certifies that the child is of an unruly character, it must commit him to a remand centre for up to 28 days. A child can only be certified in this way if: (1) he is charged either with an offence for which an adult could receive a sentence of 14 years’ imprisonment or more or with a crime of violence, or he has previously been found guilty of a crime of violence, and he cannot be accommodated in a community home; or (2) he has persistently run away from or disrupted a community home and the court feels this behaviour would be likely to be repeated. |
